How the New Jersey smoke and carbon monoxide alarm certificate works at resale, the state fee tiers, and which South and Central Jersey towns add a resale CO.

New Jersey is the only state on this site with a statewide rule. Before any one or two family home changes occupancy, the local fire official must certify that smoke alarms and carbon monoxide alarms are installed and working.

State fee tiers

Some towns set their own amounts or add a separate inspection fee. Brick Township notes a fee change effective August 12, 2026, so confirm the current figure.

The fire extinguisher rule changed

Older forms list a portable fire extinguisher. A 2025 state law dropped that requirement for resale certificates, but some town forms and checklists still mention one, so ask your fire official.

Town resale certificates of occupancy

On top of the state certificate, many towns require a resale CO or certificate of continued occupancy. These can include a full property maintenance inspection, sidewalk checks, or a sump pump check. Fees and lead times vary a lot, and several towns double the fee for late applications.

Step by step

1. Apply to the local fire official, or the construction office, as soon as you list. The state fee is lowest when you apply more than 10 business days before closing.
2. Install smoke alarms on every level and outside sleeping areas, and a carbon monoxide alarm near sleeping areas if the home has fuel-burning appliances or an attached garage.
3. If the town also requires a resale CO, schedule that inspection and fix the listed items, or ask about a temporary certificate or buyer assumption.
4. Give the certificates to the title company before closing.
